A CRISIS OF NORMATIVE LEGITIMACY OF INTERNATIONAL INVESTMENT ARBITRATION<\/strong><\/p>\r\n

The article examines the main causes of the current crisis of the legitimacy of the existing arbitration system of solving investment disputes, with special attention being paid to the origin of the theory of legitimacy in international law, as well as the normative and subjective legitimacy of international courts and arbitrations. According to the author, crisis phenomena are noted in both aspects of the legitimacy of international investment arbitration, and it was the crisis of normative legitimacy that influenced the intention of states to reform the existing arbitration mechanism for resolving investment disputes. The most radical solution in this direction is the EU proposal to completely replace the arbitration system with a permanent international investment court.<\/p>\r\n
