THE CONCEPT OF COLLEGIALITY OF THE COMPOSITION OF THE COURT WHEN CONSIDERING CRIMINAL CASES<\/strong><\/p>\r\n

The article examines and critically evaluates the leading approaches to the definition of the concept of “collegiality of the composition of the court when considering criminal cases”. On the basis of an instrumental understanding of collegiality, the author proposes its original definition, according to which the collegiality of the composition of the court should be considered as an institution of criminal procedure legislation regulating general and special issues of consideration of criminal cases by courts within the framework of unique forms of procedural cooperation (combining the efforts of several persons involved in the administration of justice) for the issuance of lawful, reasonable and fair judicial acts on criminal cases.<\/p>\r\n
