MEDICAL STERILIZATION OF VULNERABLE CATEGORIES OF CITIZENS: PROBLEMS OF LAW ENFORCEMENT PRACTICE<\/strong><\/p>\r\n

The article deals with the problems of protecting the rights of citizens in the provision of medical care related to the conduct of forced medical sterilization in relation to vulnerable categories of citizens (mostly incapacitated). It is shown that in order to improve the mechanisms of legal protection of the above categories of citizens, the legislator needs to regulate a clear procedure for making a court decision on medical sterilization in relation to an incompetent person, fixing the relevant norms in the CAS of the Russian Federation. The author also substantiates the need to expand the circle of mandatory participants in the trial under consideration by including a prosecutor and a defense lawyer.<\/p>\r\n
