IMPLEMENTATION OF THE PRINCIPLE OF RECOGNITION, PROVISION AND PROTECTION OF HUMAN AND CIVIL RIGHTS AND FREEDOMS IN RUSSIAN CRIMINAL PROCEEDINGS (HUMANISTIC AND ANTI-CORRUPTION ASPECTS)<\/strong><\/p>\r\n

The article deals with the problem of implementing the principle of recognition, provision and protection of human and civil rights and freedoms in Russian criminal proceedings. Analyzing the rights under study, the author comes to the conclusion that the above principle is not directly fixed in the criminal procedure law, but its elements permeate all stages of the criminal process, are the basis of its institutions and principles, are contained in the nature of the relationship between the participants in the proceedings and in the procedural actions. The paper reveals the content of the concept of the anti-corruption standard in the field of procedural legal relations under consideration. Information on the results of the prosecutor\u2019s supervision and judicial control over compliance with the criminal procedure legislation of the Russian Federation is presented. The author comes to the conclusion that the implementation of anti-corruption standards in this procedural activity, by establishing a unified system of prohibitions, restrictions and permits, contributes to achieving a balance of rights and legitimate interests of the prosecution and the defense.<\/p>\r\n
