GENERAL CHARACTERISTICS OF NON-FULFILLMENT OF A MILITARY ORDER<\/strong><\/p>\r\n

The paper gives a general description of the category \u00abmilitary order\u00bb, analyzes the elements and signs of the corpus delicti \u00abnon- execution of a military order\u00bb, identifies the signs of the analyzed act. The author provides an analysis of the criminally punishable act \u00abnon-execution of a military order\u00bb according to the composition of the crime, as well as the specifics of the application of Article 42 of the Criminal Code of the Russian Federation in cases of the absence of corpus delicti. The article considers the circumstances that exclude the criminality of an act in the execution of a military order. In conclusion, the author offers a list of cases in which criminal liability arises for non-fulfillment of a lawful military order and (or) execution of an illegal military order.<\/p>\r\n
