TRADEMARK DILUTION. SHALL WE EXPAND THE SCOPE OF TRADEMARK HOLDERS’ RIGHTS?<\/strong><\/p>\r\n

In the case of «famous» trademarks, it is important to preserve their «identity» and to maintain a certain «reputation» associated with such a mark. In a number of foreign jurisdictions, special remedies based on the doctrine of dilution are available to trademark holders to solve this problem. Despite the fact that the aforementioned problem is also relevant for the Russian market, this category is unknown in Russian law.
This article analyses the main approaches to the doctrine of dilution in some foreign jurisdictions and examines the mechanisms of Russian law, which are enshrined in legislation or reflected in judicial practice, and which can be used by right holders for protection against «dilution».<\/p>\r\n
