COMPARATIVE ANALYSIS OF LEGISLATION ON THE PROTECTION OF THE RIGHTS OF THE CHILD IN THE RUSSIAN FEDERATION AND THE REPUBLIC OF BELARUS<\/strong><\/p>\r\n

Abstract. The protection of children’s rights is one of the values guiding the development of the Russian Federation, which is emphasized by article 67.1 of the Constitution of the Russian Federation, which states that children are the most important priority of Russian State policy. In the Republic of Belarus, as in Russia, great attention is paid to the protection of children’s rights. In particular, article 32 of the Constitution of the Republic of Belarus establishes that marriage as the union of a woman and a man, the family, maternity, paternity and childhood are under the protection of the State.
\r\nThe legislation of the Russian Federation and the Republic of Belarus contains many provisions on the rights of the child and their protection by the state. Both states have specialized state institutions for the protection of children’s rights, in Russia these are the Ombudspersons for Children’s Rights and in Belarus the National Commission on the Rights of the Child. Based on a comparative analysis of the legal norms dedicated to the activities of the Ombudspersons for Children’s Rights in the Russian Federation and the National Commission on the Rights of the Child of the Republic of Belarus, it should be concluded that for the most effective protection of children’s rights it is necessary to legally expand the rights of the Ombudspersons for Children’s Rights in the Russian Federation, giving them the right of legislative initiative, as well as control and oversight functions.<\/p>\r\n
