CIVIL LEGAL LIABILITY OF MEDICAL WORKERS AND MEDICAL ORGANIZATIONS FOR HARM CAUSED BY PATIENTS<\/strong><\/p>\r\n

The article highlights issues related to the involvement of medical organizations and workers for harming a patient in the provision of medical services. Medical activity should be attributed to a source of increased danger, which means that compensation for harm should occur regardless of the fault of the medical organization. Special attention is paid to the mechanisms of compensation for harm and its varieties, since the harm is divided into moral and property, and its size depends on various factors. It is proposed to apply the institute of professional liability insurance for all medical workers, fill in a number of legislative gaps, namely, apply the concepts of \u00ablow-quality medical service\u00bb and establish a special statute of limitations for the legal relations considered.<\/p>\r\n
