THE CHOICE OF A PREVENTIVE MEASURE AGAINST A SUSPECT MUST BE TURNED INTO A BASIC RULE!<\/strong><\/p>\r\n

The article summarizes the results of the author’s research in the fi eld of application of criminal procedural coercive measures to suspects and accused persons, which were carried out over several years.Once again, the problems of priority in choosing preventive measures against the accused are raised; the real reasons that determine the legalization of this condition in criminal procedural legislation are identifi ed.Based on the study, the author concludes that the legal condition linking the possibility of using the measures of restraint with bringing the criminal law claim against a person in the modern conditions of the development of the doctrine, legislation and law enforcement practice is an obvious normative anachronism to be abolished! It is proposed not to regard the possibility of applying a measure of restraint to a suspect as something exceptional and applicable only under specifi c circumstances, but to use it in a general order, without taking into account the readiness to bring a criminal law claim.<\/p>\r\n
