THE ROLE OF THE CONSTITUTION IN THE PROTECTION OF RELIGIOUS RIGHTS OF CITIZENS BY THE STATE: RUSSIAN AND FOREIGN EXPERIENCE<\/strong><\/p>\r\n

The article analyses the role of the constitution in the system of state administration and its influence on the protection of religious rights of citizens. Attention is emphasised on the dual nature of the constitution: it is both a functioning pattern of society and the state and the supreme legislative act that determines the legal system of the country. Particular attention is paid to different approaches to the relationship between the state and religious groups, including such models as strong and weak secularism, pluralistic co-operation, formal recognition, weak and strong establishment. It is concluded that national peculiarities of legal, cultural and spiritual spheres influence the interpretation of constitutions in different countries, but do not prevent the creation of a common understanding of the constitution as a fundamental law. The article also considers Russian and foreign experience in the context of protecting religious rights of citizens, revealing the importance of constitutional norms in ensuring state-confessional relations and legal guarantees for believers.<\/p>\r\n
