Yakovlev Ural State Law University<\/p>\r\n<p><strong>STAGES OF CRIMINAL LAW INTERPRETATION: JUDICIAL ALGORITHM<\/strong><\/p>\r\n<p>The study at hand aims at analyzing methods and results of legal interpretation in their theoretical and practical perception, systematic interrelation, and hierarchy. The conclusion is made about the inadmissibility of the doctrine of supremacism and self-sufficiency of literal meaning, as well as its &#8220;increased effectiveness&#8221; in relation to all other interpretative results. The relationship between literal and other meanings can be expressed only algorithmically, but not hierarchically. Hence, extraordinary interpretation results are subject to application whenever the literal interpretation is unsatisfactory. Guided by the goals of interpretation as a daily courts\u2019 routine, the conditions for including a specific interpretation in a judicial act are formulated. To this end, using the terminology of F.K. von Savigny, the category of &#8220;satisfactory&#8221; interpretation was constructed in two cumulative aspects &#8211; legal and factual. Verification of the interpretation&#8217;s compliance with this category is mandatory for each interpretative process. Considering these clarifications, four stages of the interpretative process (two mandatory and two optional), as well as the rules for its application, are formulated. The relevance of the topic is determined by the data of judicial statistics, indicating the inefficiency and unsystematic nature of courts\u2019 criminal law interpretation. Given the goal of minimizing the number of judicial acts with improper application of the criminal law, which traditionally account for more than 50 % of the number of reversed, this study has a
