TO THE ISSUE OF THE REASONABILITY OF THE APPOINTMENT OF A LIQUIDATION COMMISSION (LIQUIDATOR) FOR THE VOLUNTARY LIQUIDATION OF A LEGAL ENTITY<\/strong><\/p>\r\n

The purpose of the study is to identify gaps in Russian legislation and improve legal approaches to the regulation of voluntary liquidation. In the article the author examines and criticises the provisions of the Russian legislation on the mandatory appointment of a liquidation commission (liquidator) and points out the features in the regulation of the composition of the liquidation commission (requirements to the liquidator). Based on scientific works, the author identifies the functions of the liquidation commission (liquidator) as a special body of a legal entity acting in the period of liquidation. With regard to the theoretical provisions the author defines possible ways of improvement of civil legislation on the liquidation of a legal entity. The conclusions made by the author on the results of the study, could be useful in assistance of ensuring more effective management of a legal entity and liquidation procedures during voluntary liquidation.<\/p>\r\n
