CURRENT ISSUES IN THE LEGAL SUBSUMPTION OF ILLEGAL DISTRIBUTION OF NARCOTIC DRUGS<\/strong><\/p>\r\n

The article addresses pressing issues in the legal classification of drug distribution following December 2025 amendments to the Review of Judicial Practice of the Supreme Court of the Russian Federation on cases involving the illicit trafficking of narcotic drugs, psychotropic substances and their analogues. Analyzing high-court jurisprudence, the authors systematize criteria for distinguishing between single continuing offenses and multiple counts (conjunction of crimes) in \u00abdead-drop\u00bb distribution schemes. Based on the doctrine of retroactivity, the study evaluates the legal status of individuals convicted under article 228.1 of the Criminal Code of the Russian Federation amid the Court\\’s shifting interpretive approach. The authors formulate proposals to ensure uniform judicial practice and enhance the regulatory and deterrent potential of current criminal provisions.<\/p>\r\n
