APPLICATION OF LEGAL DESIGN IN LEGAL WORK AT THE ENTERPRISE

The article is devoted to contemplation on the essence and types of legal design and its use in legal work at the enterprise in two aspects: external and internal. The first aspect is analyzed depending on the functions performed by lawyers in the enterprise. Thus, the use of legal design is considered in the framework of modeling, implementation and insurance of the organization’s business processes, as well as in the course of interaction between a lawyer and other employees and departments of an enterprise. The external side of the relationship of the legal department of the enterprise mainly concerns contractual work with counterparties, as well as the fulfillment of public law requirements. It is noted that legal design in this case can be used in the negotiation and contract drafting processes.

ПРИМЕНЕНИЕ LEGAL DESIGN В ПРАВОВОЙ РАБОТЕ НА ПРЕДПРИЯТИИ

В статье последовательно рассматривается сущность и виды legal design, а также его использование в правовой работе на предприятии в двух аспектах: внешнем и внутреннем. Первый аспект анализируется в зависимости от функций, выполняемых юристами на предприятии. Так, применение legal design рассматривается в рамках моделирования, реализации и подстраховки бизнес-процессов организации, а также в ходе взаимодействия юриста с другими сотрудниками и отделами предприятия. Внешняя сторона взаимоотношений юридического отдела предприятия в основном касается договорной работы с контрагентами, а также выполнения публично-правовых требований. Отмечается, что legal design в этом случае может использоваться в переговорном процессе и в ходе договорной работы.
