LEGAL FEATURES OF THE INHERITANCE AGREEMENT IN THE RUSSIAN FEDERATION

In the article, the author examines the norms of domestic legislation governing the inheritance agreement. The peculiarities in the procedure for conclusion, execution and termination of the inheritance agreement are considered. The dual nature of the inheritance agreement was determined and its differences from the will were revealed. It was concluded that the presence of a number of unresolved problems in the legal regulation of the inheritance agreement gives rise to certain problems in law enforcement practice.

ПРАВОВЫЕ ОСОБЕННОСТИ НАСЛЕДСТВЕННОГО ДОГОВОРА В РОССИЙСКОЙ ФЕДЕРАЦИИ

В статье автором исследуются нормы отечественного законодательства, регулирующие наследственный договор. Рассмотрены особенности в порядке заключения, исполнения и расторжения наследственного договора. Определена двойственная природа наследственного договора и выявлены его отличия от завещания. Сделан вывод о том, что наличие ряда нерешенных проблем в правовом регулировании наследственного договора порождает определеные проблемы в правоприменительной практике.
