PLEDGE MANAGEMENT AGREEMENT AND ASSIGNMENT AGREEMENT

The comparison of such contractual structures as the pledge management agreement and the assignment agreement does not raise questions about the expediency and practical significance: perhaps, the ratio of these agreements can be recognized as the cornerstone problem of the theory of the institute of pledge management, since the establishment of the legal nature of the pledge management agreement directly depends on the solution of the task. The paper deals with the main problems of the correlation of these types of contracts, the signs that distinguish them from each other, as well as the importance of each of the analyzed contractual structures in civil circulation.

ДОГОВОР УПРАВЛЕНИЯ ЗАЛОГОМ И ДОГОВОР ПОРУЧЕНИЯ

Сопоставление таких договорных конструкций, как договор правления залогом и договор поручения, не вызывает вопросов относительно целесообразности и практической значимости: пожалуй, соотношение этих договоров можно признать краеугольной проблемой теории института управления залогом, поскольку от решения поставленной задачи напрямую зависит установление правовой природы договора управления залогом. В работе рассмотрены основные проблемы соотношения данных видов договоров, признаки, отличающие их друг от друга, а также значение каждой из анализируемых договорных конструкций в гражданском обороте.
