THE DIGITAL FORM OF CIVIL CIRCULATION FUNCTIONING

In the development of the author’s idea of the need to distinguish the actual and legal forms of functioning of civil circulation, consisting in the change of owners of circulation objects, and determined by the shape of the objects being wrapped, the thesis about the actual, and not the legal nature of the actions of the subjects participating in the circulation in the digital environment is substantiated. Based on this, it is concluded that the digital form of the change of owners of objects (through electronic and digital technologies or exclusively in the digital environment) should be attributed to the actual form of functioning of civil circulation.

ЦИФРОВАЯ ФОРМА ФУНКЦИОНИРОВАНИЯ ГРАЖДАНСКОГО ОБОРОТА

В развитие авторской идеи о необходимости выделения фактической и юридической форм функционирования гражданского оборота, состоящего в смене обладателей объектов оборота, и детерминированного формой оборачиваемых объектов, обосновывается тезис о фактическом, а не юридическом характере действий субъектов – участников оборота в цифровой среде. Исходя из этого, делается вывод о том, что цифровую форму смены обладателей объектов (посредством электронно-цифровых технологий или исключительно в digital-среде) следует относить к фактической форме функционирования гражданского оборота.
