THE PURPOSE AND OBJECTIVES OF CASUAL INTERPRETATION

The article draws a correlation between the categories «purpose» and «objectives» of casual interpretation. The author draws attention to the fact that the intended purpose of the casual interpretation of the norm is the accumulation of typical and atypical elements of the legal implementation process. It is established that the purpose of casual interpretation is to clarify the meaning of the content of a rule of law in relation to a specific situation that requires an individual approach. Based on this, four objectives of casual interpretation of a legal text are defined. As a result, it is concluded that purpose and objectives of casual interpretation are closely related, and therefore cannot be implemented separately from each other.

ЦЕЛЬ И ЗАДАЧИ КАЗУАЛЬНОГО ТОЛКОВАНИЯ

В статье проводится соотношение категорий «цель» и «задачи» казуального толкования. Автор обращает внимание на тот факт, что целевое предназначение казуального толкования нормы состоит в аккумуляции типичных и атипичных элементов правореализационного процесса. Устанавливается, что цель казуального толкования заключается в выяснении смысла содержания нормы права применительно к конкретной ситуации, требующей индивидуального подхода. Исходя из этого определяются четыре задачи казуального толкования юридического текста. В итоге делается вывод о том, что цели и задачи казуального толкования находятся в тесной связи, а потому не могут быть реализованы отдельно друг от друга.
