THE SPECIFICS OF EVALUATING THE RESULTS OF INTELLECTUAL ACTIVITY FOR THE PURPOSE OF THEIR COMMERCIALIZATION ON THE EXAMPLE OF THE TRANSPORT SECTOR IN THE RUSSIAN FEDERATION

The article presents the main features of the evaluation of the results of intellectual activity for the purpose of their commercialization on the example of the transport sector in the Russian Federation. The legal framework, the methodological component of the evaluation process is considered. Problems and ways of development are revealed.
As a result of the consideration of the mechanisms for assessing the cost of RID for the purpose of commercialization in the transport sector, conclusions are drawn: the methodological basis of the assessment is based on civil law, accounting legislation, the legal framework of the transport complex of Russia; the evaluation of rights to RID is determined by the specifics of the transport sector at the stage of taking into account the conditions of development of the industry and the possibility of using RID in activities; there is a certain fairly complete legal framework that would regulate all issues related to the assessment of RID; in the transport sector, the shortcomings of the federal level of legal regulation of the evaluation of rights to RID are solved by creating local acts; in the future, it is proposed to improve the regulatory framework for the evaluation of rights to RID, taking into account industry specifics and the current state of economic and production activities of domestic enterprises.

СПЕЦИФИКА ОЦЕНКИ РЕЗУЛЬТАТОВ ИНТЕЛЛЕКТУАЛЬНОЙ ДЕЯТЕЛЬНОСТИ С ЦЕЛЬЮ ИХ КОММЕРЦИАЛИЗАЦИИ НА ПРИМЕРЕ ТРАНСПОРТНОЙ СФЕРЫ В РОССИЙСКОЙ ФЕДЕРАЦИИ

В статье приведены основные особенности оценки результатов интеллектуальной деятельности с целью их коммерциализации на примере транспортной сферы в Российской Федерации. Рассмотрена правовая база, методическая составляющая процесса оценки. Выявлены проблемы и пути развития.
В результате рассмотрения механизмов оценки стоимости РИД с целью коммерциализации в транспортной сфере, сделаны выводы: методическая основа оценки базируется на гражданском праве, законодательстве в области бухгалтерского учета, правовой базе транспортного комплекса России; оценка прав на РИД определяется спецификой транспортной сферы на этапе учета условий развития отрасли и возможность применения РИД в деятельности; пока не существует определенной достаточно полной правовой базы, которая регламентировала бы все вопросы, связанные с оценкой РИД; в транспортной сфере недостатки федерального уровня правового регламентирования оценки прав на РИД решаются путем создания локальных актов; в дальнейшем предлагается совершенствование нормативной базы оценки прав на РИД с учетом отраслевой специфики и текущего состояния хозяйственной и производственной деятельности отечественных предприятий.
